Just remember, however, if you're going to use DRM for a work that may not be subject to copyright, it won't give you any protection under the anticircumvention provisions of the DMCA (at 17 U.S.C. 1201). That section prohibits circumvention of technological measures that effectively control access to works protected under the Copyright Act. The Lexmark v. Static Control case addresses this point: "To the extent [a work] is not a 'work protected under [the copyright statute],' the DMCA necessarily would not protect it." 387 F.3d 522, 550 (6th Cir. 2004).
