Publishing two separate works in the same publication (i.e.
on a
webpage) does not make either one a derivative of the other.
Even if the
photo and the text expresses the same idea the forms of
expression are
so different that they remain independent works. The rule
that music
which has been "synct" to a motion picture is
(IMHO) an unfortunate
extension of the copyright of the motion picture producer
but it's, as I
understand it, an necessary component of the license because
of some
U.S. regulation.
