I have received many emails - allegedly from myself - that
are not
*legally* defined as spam (as I understand the law - the can
spam act
of 2003) but that are indeed unsolicited and hide behind
certain
verbiage in the can spam act.
1. The email:

Date: Thu, 22 Mar 2007 01:58:44 -0500 (CDT)
From: EttCom-Eric-Public <ADDRESS MY-DOMAIN.net>
Message-Id: <200703220658.l2M6wip2032569 MY-DOMAIN.net>
To: ADDRESS MY-DOMAIN.net
we email advertise your charity web site to 7,500,000
people. free.

This is a very common message (Goggle it) from a person that
others
define as a known spammer (such accusations are not mine,
but rather
can be found on numerous mail admin Usenet postings.
2. How its not defined *legally* as spam.
The following is from the actual act itself, as found at:

(D) REFERENCE TO COMPANY OR WEBSITE- The inclusion of a
reference to a
commercial entity or a link to the website of a commercial
entity in
an electronic mail message does not, by itself, cause such
message to
be treated as a commercial electronic mail message for
purposes of
this Act if the contents or circumstances of the message
indicate a
primary purpose other than commercial advertisement or
promotion of a
commercial product or service.
So...since the message doesn't appear to be categorized as
spam, even
though they've spoofed the from address, I can't report
them.
Something worth note is that they somehow harvested this
from server
(VPS with Verio) because the name they give to the email
address is
exactly how the account is defined on the server.
3. The quandary...Report myself as a spammer?
As I have this account forwarded to my Gmail account, my
temptation is
to just click the "Report As Spam" button...but I
am the sender,
allegedly. Am I placing my domain in jeopardy of being
blocked by
Gmail if I do this, or will Gmail capture the text of the
message and
solely rely on that when filtering mail?
Any and all guidance on this issue is appreciated.

P.S. I thought it would be fun to form a non-profit that
seeks to
expand the definition of spam to include these types of
email and take
them up on their free offer given in the email - that would
be fun.

Hi Eric,
This kind of spoofing goes on all the time. Not much you can do about it. Most people now understand that the from addresses on spam are meaningless so most people won't immediately conclude that you are a scumbag spammer.
If they are spoofing your domain though you should contact your domain registrar and let them know what is going on to avoid problems with your registrar.

Hi Eric,
what you would need to do is to get the host of your mail
service to
publish a SPF record for the domain
Definition by Google: Sender Policy Framework (SPF) records
allow
domain owners to specify which hosts are permitted to send
email on
behalf of their domains, making it hard to forge From:
addresses. We
strongly encourage you to publish SPF records for your
domain --
having these records in place will ultimately help fight
spam.
Contact the administrator of your domain, get the SPF
records
published. It prevents (or atleast tries to prevent)
spammers from
spoofing your domain.

I can honestly attest that this only helps 50%. I have an
SPF record
on my domain, yet I still get lots of bounces from Hotmail,
Earthlink,
and a couple others, indicating they didn't read the SPF or
believe
it, and still let them spoof my domain.
But it does help. It'll help more when more ISPs adopt it's
use.
