Others have had the same problem; it is frustrating, and
nobody knows why it
happens. I have no idea if this will work, but you might try
setting up a
label for that sender and then creating a filter that
directs those emails to
skip the inbox and archive directly to that label. Perhaps
that will override
the spam filter. Beyond that, the only thing you can do -

I did some testing with my gmail accounts, and found that
gmail is dropping
emails. I sent several emails from a Google Apps hosted
account to a gmail
account, and two of those emails didn't reach the recipient.
