weird banned-cache problem

I am running Maia 1.0.2 on Debian Etch.  Everything is
working great 
minus one small problem.  It seems that if one one email is
in the 
banned-file cache, then it cant be rescued.  Whenever a
second or third 
email hits the cache, then everything can be confirmed and
its released 
to the users mail box.  Has someone else seen anything
similar?
