(NewsTarget) When a couple on a recent Southwestern Airlines flight decided to engage in some sexual play while in flight, they most likely did not realize that their actions would land them as violators of the Patriot Act -- which was intended for terrorists. In fact, the sexual in-flight activity could land them both in prison for 20 years.

Carl Persing and Dawn Sewell were allegedly snuggling and kissing inappropriately while making other flight passengers uncomfortable -- according to the court indictment. A flight attendant asked the pair to stop their activity as it progressed.

According to the indictment filed by the FBI, both Persing and Sewell were observed nuzzling and Persing was seen kissing Sewell on the neck. In addition, Persing was apparently witnessed with his face pressed against Sewell's vaginal area, while Sewell was observed smiling.

After a second warning from the flight attendant, Persing apparently had an outburst that included him shouting that there would be "serious consequences" to the flight attendant if the pair was not left alone.

That comment was enough to seal the arrest of both Persing and Sewell, who were arrested in Raleigh, North Carolina once the Southwestern flight reached its last destination. The couple -- who are in their 40s -- were charged with obstructing a flight attendant in addition to being charged with criminal association

At this time, both Persing and Sewell have been placed under legal surveillance until their trial on February 5, 2007. If both Persing and Sewell are found guilty, both could be sentenced to 20 years in jail.

William Peregoy -- Persing's lawyer -- stated that Persing was not feeling well when he rested his head in the lap of Sewell, and that Persing also only threatened the flight attendant by saying he would report him to his superiors once the plane landed.
